Quick summary

ManagedMember provides digital member card setup, QR join pages and managed wallet, email and SMS campaign services for local businesses. We collect business setup information from businesses that buy our services, and customer/member information from people who choose to join a participating business member program.

We use this information to create and manage digital member cards, operate join pages, send approved campaign messages, process payments, provide support, improve the service and meet legal obligations. Customers can unsubscribe from marketing messages at any time.

This page combines our Privacy Policy, Terms of Service, Refund Policy, marketing consent wording, unsubscribe policy, support contact information and business data handling terms.

4. Business data handling

For businesses using ManagedMember, we act as a service provider helping operate your member card and campaign program.

The member data collected through your join page is used to deliver your member program and approved campaigns. We do not sell member data to third parties. We do not use a business’s member list to market unrelated third-party products.

Businesses are responsible for ensuring that any offers, promotions, campaign content, business information, logos and customer-facing claims they provide are accurate, lawful and not misleading.

We may access business and member data where needed to provide setup, support, campaign execution, billing, reporting, troubleshooting, security and compliance services.

If a business stops using ManagedMember, we may retain records where needed for legal, accounting, dispute, security and operational purposes. A business can contact us to request an export or deletion review of its data, subject to legal and operational requirements.

5. Marketing consent for SMS and email

When customers join a participating business member program, the join form may ask them to consent to receive member updates, offers and reminders by channels such as wallet updates, email and SMS.

Example consent wording used by participating businesses may include:

I agree to join this business’s member program and receive member updates, offers and reminders by digital wallet, email and SMS. I can unsubscribe from marketing messages at any time.

We and the participating business may use the consent record to decide whether a customer can receive campaign messages. Transactional or service messages may still be sent where necessary to provide the service, confirm setup, provide support, or manage a digital member card.

6. Unsubscribe and opt-out policy

Customers can unsubscribe from marketing emails using the unsubscribe link included in campaign emails.

Customers can opt out of SMS marketing by following the opt-out wording in the SMS, such as replying STOP where supported by the SMS provider, or by contacting us or the participating business.

We will take reasonable steps to apply unsubscribe and opt-out requests to future marketing campaigns. Some transactional messages may still be sent where necessary to provide the service or respond to a request.

Businesses using ManagedMember must not ask us to send marketing messages to people who have unsubscribed, opted out, or have not provided the required consent.

7. Third-party services

We use third-party service providers to operate ManagedMember. These may include:

  • payment processors such as Stripe and/or WooCommerce payment services;
  • digital wallet issuing services such as WalletWallet;
  • email delivery providers such as SendGrid;
  • SMS delivery providers such as Texto or other SMS providers;
  • website hosting, security, analytics, form and support tools.

These providers may process data for the purpose of providing their services to us. Their own terms and privacy policies may also apply.

8. Security

We take reasonable steps to protect information from misuse, interference, loss, unauthorised access, modification and disclosure. No online service can guarantee absolute security.

Businesses should also take reasonable care when sending us logos, campaign instructions and customer-related information, and should avoid sending unnecessary sensitive information.

9. Access, correction and deletion requests

Customers and business representatives can contact us to ask about personal information we hold, request correction, or request deletion review where applicable.

Some information may need to be retained for legal, tax, accounting, security, dispute resolution, operational or compliance reasons.

10. Terms of Service

By buying or using ManagedMember, a business agrees to these terms.

What ManagedMember provides

ManagedMember provides digital member card setup, QR join page setup, campaign tools, managed campaign services, reporting and related support. The exact inclusions depend on the product, plan, campaign quote or invoice purchased.

Business responsibilities

Businesses are responsible for:

  • providing accurate business, billing and campaign information;
  • having rights to use any logos, images, brand assets and content supplied to us;
  • ensuring offers, promotions and campaign content are accurate and lawful;
  • honouring offers they ask us to publish or send;
  • not using ManagedMember to send unlawful, misleading, harmful, abusive or spam messages;
  • responding to customer enquiries relating to their own offers, goods or services.

Managed campaigns

Campaigns may be quoted separately based on the selected channels, audience size, message length, SMS parts, urgency and campaign work required. We may require payment before sending a billable campaign.

We may refuse or pause a campaign if we believe the content, audience, consent status, payment status or requested use of the service creates legal, deliverability, reputational, security or operational risk.

Service availability

ManagedMember depends on third-party services including hosting, payment processors, wallet issuing services, email delivery providers and SMS providers. We aim to provide a reliable service but do not guarantee uninterrupted availability or delivery of every wallet update, email or SMS.

Intellectual property

Businesses keep ownership of the logos, brand assets and content they provide. ManagedMember owns or licenses the software, workflows, templates, page designs, campaign tools and service materials used to provide the ManagedMember service.

11. Refund Policy

Our refund approach is designed for a setup-and-service product.

Digital Member Card Setup

If you buy the Digital Member Card Setup and change your mind before we have started setup work, contact us as soon as possible and we will review your refund request.

Once setup work has started, setup fees may be non-refundable or partly refundable depending on the work already completed, third-party costs incurred and the reason for the request.

Campaigns

For campaign invoices, if a campaign has not yet been prepared or sent, contact us as soon as possible and we will review the request. Once a campaign has been prepared, scheduled, sent, or third-party message costs have been incurred, refunds may not be available for that completed work or delivery usage.

Consumer guarantees

Nothing in this Refund Policy is intended to exclude rights or remedies that cannot be excluded under Australian Consumer Law or other applicable laws.

12. Limitation of liability

To the maximum extent permitted by law, ManagedMember is not liable for indirect, incidental, special, consequential or loss-of-profit damages arising from use of the service.

Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law, including, where applicable, resupplying the service or paying the cost of having the service supplied again.

13. Changes to this page

We may update this page from time to time. The updated version will be posted on this website with a revised “Last updated” date.
